Agreement Terms

Assumption of Risk

I understand that operating or riding an electric motorcycle, electric dirt bike, or other powersports vehicle involves inherent risks that may result in serious bodily injury, permanent disability, paralysis, death, property damage, or other losses.

I voluntarily choose to participate in this demonstration ride and acknowledge that I am solely responsible for determining whether I possess the skill, physical condition, experience, and judgment necessary to safely operate the vehicle.

I knowingly and voluntarily assume all risks associated with this demonstration ride, whether known or unknown, foreseeable or unforeseeable, including but not limited to:

• Loss of control
• Mechanical failure
• Battery or electrical failure
• Collisions with people, vehicles, animals, or objects
• Falls or rollovers
• Changing terrain or weather conditions
• Operator error
• Negligence of myself or others
• Any other hazards associated with motorcycle or off-road vehicle operation

I understand these risks may result in serious injury, permanent disability, or death.

Release of Liability

To the fullest extent permitted by applicable law, I release, waive, discharge, and covenant not to sue the following parties, collectively the “Released Parties”:

• The participating dealership providing the demonstration vehicle;
• Kickin Bikes LLC;
• Apollo;
• RFN;
• The manufacturer, importer, distributor, supplier, and any component manufacturers of the demonstration vehicle;
• Any parent companies, subsidiaries, affiliates, successors, assigns, officers, directors, members, managers, shareholders, owners, employees, contractors, volunteers, agents, representatives, insurers, licensors, and legal representatives of any of the foregoing entities.

I release the Released Parties from any and all claims, demands, causes of action, liabilities, damages, expenses, attorney’s fees, or losses arising out of or relating in any way to my participation in this demonstration ride, including claims based upon the alleged negligence of any Released Party, except where prohibited by law or arising from gross negligence, reckless misconduct, or intentional misconduct.

Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, lawsuits, liabilities, damages, attorney’s fees, costs, or expenses arising from:

• My operation or use of the demonstration vehicle;
• My violation of any law, regulation, or instruction;
• Injury to myself or any other person;
• Damage to any property;
• Claims brought by any third party resulting from my actions.

Rider Representations

I certify and represent that I am at least eighteen (18) years of age, possess sufficient experience and skill to safely operate this vehicle, hold a valid driver’s license, am physically capable of safely operating the vehicle, am not under the influence of alcohol, illegal drugs, prescription medications, or any substance that may impair my ability to safely operate the vehicle, will wear all required safety equipment, will follow all dealership instructions, will operate only within the designated demonstration area, and will immediately stop operating the vehicle if I believe it is unsafe to continue.

Vehicle Condition and No Warranties

I acknowledge that I have had the opportunity to inspect the demonstration vehicle and accept it in its present condition. The demonstration vehicle is provided solely for evaluation purposes and is provided “AS IS” without any warranty or representation regarding its safety, fitness, or suitability for my intended use.

Medical Authorization

If emergency medical treatment becomes necessary during or after the demonstration ride, I authorize emergency medical personnel to provide treatment as they deem appropriate. I accept full responsibility for any medical expenses incurred.

Binding Effect, Severability, and Governing Law

This Agreement is binding upon me, my heirs, estate, executors, administrators, personal representatives, successors, assigns, and anyone acting on my behalf. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and interpreted under the laws of the state in which the demonstration ride occurs.
